"Deceptive" Esperance car dealer suspended – GS Motors

An Esperance car dealer has had his licence to operate suspended for three months by the State Administrative Tribunal in Perth for failing to record the purchase of a vehicle and for deceptive conduct.

Stephen George Poyner, who operates the car dealership GS Motors in Esperance as well as Hollywood Hire Cars, breached the Motor Vehicle Dealers Act when he failed to enter the purchase of 1998 Mitsubishi Magna, valued at $3,000, into the register of transactions as required. Mr Poyner also failed to notify the Department of Transport of the change in ownership.

After its subsequent sale, the Magna was involved in a serious accident and the driver had fled the scene. During the investigation into the accident, Mr Poyner made untrue statements to Police and attempted to induce the previous owner of the vehicle to do the same.

Mr Poyner also issued an invoice for $640 to the previous owner of the Magna for the hire of another vehicle, but no money changed hands.

On 1 March 2012 Mr Poyner was fined $3,700 by the Esperance Magistrates Court and ordered to pay Court costs of $6,540 over the same matter.

In handing down the penalty at the time, Magistrate Tanya Watt said the conduct of Mr Poyner was deceptive as he had tried to avoid liability.

After being reprimanded by the SAT, Mr Poyner had his licence suspended for three months and was ordered to pay costs of $500.
