A building contractor who has submitted a tender or is contracted to undertake State Building Work is covered by the Building and Construction Industry Code of Conduct 2016 (the BCI Code).

Private building work procured by way of a tender process, or if not procured by a tender process but a contract for Building Work was executed, whilst the building contractor is covered by the BCI Code, is also covered by the BCI Code.

A building contractor must provide advice in writing when such Private Covered Building Work has a value in excess of $2 million.
