Kalgoorlie builder’s registration restricted

The Building Services Board has imposed a condition on the building contractor registration of Kalgoorlie builder Simon Pekovich Homes Pty Ltd (BC66114), trading as Amberley Homes.

The condition imposed on 11 April 2017 prohibits the company from entering into contracts for the carrying out of building work. The condition was imposed by the Board due to concerns about the contractor’s ability to pay its debts as and when they fall due.

“People dealing with this company should be cautious and should only make payments or give credit when the company confirms its financial situation,” Building Commissioner Peter Gow said.

All registered building contractors are required to notify the Building Commission if they are no longer able to meet their financial obligations under the Building Services (Registration) Act 2011. The Building Commission has not received such a notification from Simon Pekovich Homes.

The Building Commission has been unable to contact Simon Pekovich Homes and is pursuing avenues to assist home owners left with unfinished work.

As the builder has not entered into voluntarily administration, the home owners’ home indemnity insurance (HII) policies have not yet been triggered. In the meantime, home owners might consider obtaining advice, including legal advice, about whether they can take action in court or otherwise that will result in the triggering of their HII.

The company is no longer eligible for home indemnity insurance. Also, the company currently has no nominated supervisor, so its building contractor registration has no effect. The condition imposed on the company’s building contractor registration would prevent the company from entering into contracts for building work if it did appoint a nominated supervisor.

“People should not enter into a building work contract with Simon Pekovich Homes unless the condition on its registration is lifted,” Mr Gow said.

“The status of a builder’s registration, including any conditions imposed by the Board, can be viewed on the register on the Building Commission website www.commerce.wa.gov.au/buildersearch or phone 1300 489 099.”
