A Cannington company and one of its directors have been prosecuted by the Building Commissioner and fined a total of $6,000 for registration offences the company committed while contracting for the fit-out of a Wellard fast food outlet in 2014.

The Perth Magistrates Court convicted Hospitality & Kitchen Needs Pty Ltd of two offences under the Building Services (Registration) Act 2011. The offences were holding out or implying that it was a registered builder when it was not; and undertaking to carry out a prescribed building service while unregistered.

The company was fined $4,000 and the director, who was taken to have committed the same offences, was granted a spent conviction and ordered by the court to pay a $2,000 fine and costs of $854.20.

The court heard the company had used a builder’s registration number that did not belong to it when contracting for the fit-out work, which was valued at $116,000.

“In Western Australia a builder must be registered to contract for or carry out building work valued over $20,000,” Building Commissioner Ken Bowron said.

“Hospitality & Kitchen Needs’ conduct was illegal and deprived the building’s owners of their right to engage an appropriately registered building service provider.

“The registration system is an important protection for consumers and the building industry – it ensures that a person has the qualifications and experience necessary to carry out work to the required standards.

“We will continue to hold to account those who put the public interest and the reputation of the building industry at risk.”
