There are two systems of employment law that operate in WA – the state industrial relations system and the national fair work system. 

These systems have different employment obligations, so getting the right information is critical. Employers and employees cannot choose which system they operate under.

The state system includes businesses and organisations (and their employees) that operate as sole traders, unincorporated partnerships, unincorporated trust arrangements, and some incorporated or not-for-profit organisations.

The national system covers businesses and organisations (and their employees) that operate as Pty Ltd businesses, incorporated partnerships, incorporated trust arrangements, and some incorporated or not-for-profit organisations.
