Building service providers – changes and new obligations

From 1 February 2023, changes to the Building Services (Registration) Act 2011 as made by the Building and Construction Industry (Security of Payment) Act 2021 came into effect. The changes include new powers of the Building Services Board (the Board) to manage the commercial conduct and behaviour of building service providers and new obligations for building service providers. 

The Board has been given additional powers to take action against builders and other providers who fail to pay debts to subcontractors and to remove those with a history of financial failure.

Building service providers that are ‘bodies corporate’ are required to notify the Building Service Board in writing of the appointment of any new director within 7 days of the director being appointed – see the Notification of new director form.
