    For almost 20 years prior to entering the law, Christopher worked in construction of commercial projects for some of Australia’s larger contractor, and later design and construction project management of hotels and resorts both within Australia and South East Asia.  During that time, he developed an expertise in addressing distressed projects, often called upon to reorganise projects and bring them back on track. In such roles he was substantially involved in dispute management and resolution at the coal-face, such involving delays, prolongation, defective work, variations, and cost overruns.

    In the 1990’s he was predominantly active in Thailand, Singapore, the Maldives, and Burma, whilst consulting on projects in the Middle East, Guam, and the Philippines.     Max is a Chartered Professional Engineer with more than 45 years experience in building and engineering projects, including 25 years in contract development, contract administration and dispute resolution.

    From 2001 until 2005 Max was General Manager, Procurement Systems in the NSW Department of Commerce (formerly Department of Public Works and Services, now Department of Finance, Services and Innovation). The Department managed a very extensive building and engineering capital works program for the State. Max was responsible for tendering and contracting systems for construction projects. He provided advice to the Minister and Department officers on all aspects of building and engineering construction contracts, including contracting strategies, commercial terms, selection of service providers and contract administration. From 1995 to 2001 Max was Manager Contracts, responsible for the management and resolution of construction contract disputes by mediation, expert determination, arbitration and litigation.     Mr Windross has substantial experience in contract administration in a wide range of industries, including telecommunications, civil engineering, resources, major building and domestic construction.

    Caroline is an experienced construction disputes lawyer with a background in both law and architecture.

     

    After graduating with a Bachelor of Architecture from the University of Western Australia, she worked for Jurong Town Corporation in Singapore designing commercial and industrial buildings for the industrial developer. Since then, she completed a Bachelor of Laws with First Class Honours at Murdoch University and went on to work in the construction and professional indemnity team at a Western Australian law firm. Caroline has also worked at a top tier law firm within the construction disputes team for many years.

    She was also seconded to a Contractor working in the mining sector for a brief time. In 2010, Caroline completed a Graduate Diploma in Construction Law from the University of Melbourne.

    Caroline’s experience has largely been in relation to construction disputes in the mining and energy sectors. She has adjudicated construction payment disputes arising in the mining, residential and retail sectors. Her formal qualifications are set out below.

    Stuart is a civil engineer with a professional career spanning over 40 years in the building and construction industry.

    His career initially focused on engineering design, documentation and construction management. He then specialised in commercial dispute resolution for construction and goods & services procurement for the NSW Government, including in the application of mediation, expert determination, arbitration and litigation. He progressed to become responsible for the NSW Government’s Procurement System for Construction used for the procurement of some $1.0Bn of government infrastructure annually, developing new contracts and contract management systems, and providing advice to government on procurement policy, legislation and practice [including the Building and Construction Industry Security of Payment Act 1999 (NSW)].

    Stuart left his employment in the public sector in mid-2012 and became accredited under the Security of Payment Acts in NSW and the ACT and registered under the BCIPA in Qld [now registered under the Building Industry Fairness (Security of Payment) Act 2017 QLD]. He has completed around 200 Adjudication Determinations/ Decisions to date.
