A person who has an obligation under the Work Health and Safety (General) Regulations or the Work Health and Safety (Mines) Regulations may submit a request to the regulator to be exempted from fully complying with the requirement of these regulations.

Request an exemption from Work Health and Safety (General) Regulations

To request an exemption, complete a Request for exemption form.  The form should be emailed to review.officer@dmirs.wa.gov.au, or mailed to WorkSafe Western Australia Commissioner, Locked Bag 100 East Perth 6892, or hand deliver it to Level 1, Mason Bird Building, 303 Sevenoaks St, Cannington WA 6107. 

Please note: this form must specify: 

  • the WHS regulation for which the exemption is required;
  • the time-frame or period for which the exemption is required; and
  • the date the exemption is required by.  

In addition you will need to describe in detail the reason why the regulator should grant you an exemption from complying with the regulation/s and provide any documentation to support your request.  You should provide information about how you will maintain safety and health standards, whether there are any exceptional circumstances, and what consultation you have done with workers or other affected PCBUs.

Request an exemption from Work Health and Safety (Mines) Regulations

Mine operators applying for an exemption from the Work Health and Safety (Mines) Regulations 2022 for a mining operation are required to complete the Request for an exemption via SRS for a mining operation form and submit it through SRS.

If an exemption is sought for multiple mining operations, a separate exemption request should be submitted for each mining operation.
