Please note: From 1 July 2011 responsibility for the regulation of the settlement industry in Western Australia was transferred from the Settlement Agents Supervisory Board (the Board) to the Department of Commerce (the Department) and the Commissioner for Consumer Protection (the Commissioner). New rules for agents to combat real estate fraud

Amendments to the Settlement Agents Code of Conduct 1982 requiring mandatory identification checks by agents of all people wishing to sell their property will take effect from 1 November 2011. These changes are being implemented to better protect WA property owners following the fraudulent sale of two Perth properties in the last thirteen months.

The below Guidance Notes have been developed to assist agents in their compliance with the amended Code of Conduct.
